Terms of Service for Agallas Cares

1. Introduction and Acceptance of Terms

Welcome to Agallas Cares (“Agallas,” “we,” “our,” or “us”). Agallas Cares is a nonprofit organization dedicated to strengthening communities through civic engagement, youth empowerment, and community-driven events. These Terms of Service (“Terms”) govern your use of our website, participation in our programs, and attendance at our events.

By accessing our website, registering for a program, or attending an event, you agree to comply with these Terms. If you do not agree, please refrain from using our services or participating in our activities.

Agallas Cares is a nonprofit organization committed to building stronger, more equitable communities. Our core initiatives include:

Youth Empowerment – Leadership development, mentorship programs, skill-building workshops, and educational opportunities for young people.
Community Events – Neighborhood cleanups, cultural celebrations, health and wellness fairs, and other gatherings that foster connection and collaboration.

All Services are provided free of charge or at a nominal cost, consistent with our nonprofit mission. Specific program details, eligibility, and schedules will be communicated separately.

4. Eligibility and Participation

Participation in our programs and events is open to all individuals who:

Are at least 13 years old (minors under 18 require parental/guardian consent)
Provide accurate registration information
Agree to abide by these Terms and our code of conduct

Agallas Cares is committed to creating safe, inclusive, and respectful environments. All Participants agree to:

Treat staff, volunteers, fellow Participants, and community members with dignity and respect
Refrain from harassment, discrimination, bullying, or violence of any kind
Comply with all applicable laws and venue rules
Avoid any behavior that could damage Agallas Cares’ reputation or property

Violations of this Code of Conduct may result in removal from events, suspension from programs, or permanent banning from future participation.

7. Youth Participants and Parental Consent

For Participants under 18 years of age:

A parent or legal guardian must provide signed consent for participation
Parents/guardians are responsible for supervising their children during events unless otherwise specified
We may require additional permissions for off-site activities or media release

By registering a minor, the parent/guardian accepts these Terms on behalf of the minor and assumes responsibility for their conduct.

8. Donations and Financial Contributions

As a nonprofit organization, Agallas Cares accepts donations to support our mission. All contributions are voluntary and non-refundable unless required by law.

Donations may be tax-deductible to the extent permitted by law. We will provide appropriate receipts.
We reserve the right to refuse or return donations at our discretion.

Fundraising events are subject to separate terms, which will be provided at the time of participation.

9. Payment for Fee-Based Programs

While most of our Services are free, some programs may involve a nominal fee to cover materials, meals, or venue costs. Payment terms (if applicable) will be disclosed during registration.

We reserve the right to:

Require advance payment
Offer refunds on a case-by-case basis
Waive fees for participants with financial need, consistent with our mission

10. Intellectual Property

All content on our website—including logos, branding, educational materials, workshop curricula, and event designs—is the property of Agallas Cares unless otherwise credited.

You may not:

Reproduce, distribute, or commercially exploit our materials without prior written permission
Use our name, logo, or branding in a way that implies endorsement or affiliation without consent

You retain ownership of your User Content, but by submitting it, you grant Agallas Cares a non-exclusive, royalty-free license to use, share, and promote it for mission-related purposes, with proper attribution where feasible.

11. User-Generated Content and Social Media

We encourage Participants to share their experiences. However, you agree not to post or share:

Offensive, defamatory, or harmful content
Content that violates others’ privacy or intellectual property rights
False or misleading information about Agallas Cares or our programs

We reserve the right to remove or moderate User Content that violates these Terms.

12. Photography and Media Consent

Events and programs may be photographed or recorded for promotional, educational, or reporting purposes. By attending or participating, you grant Agallas Cares the right to use your likeness in such materials, unless you expressly opt out in writing.

We will make reasonable efforts to accommodate opt-out requests, but cannot guarantee exclusion from group photos or large-scale recordings.

13. Privacy and Data Protection

Your privacy is important to us. Our use of personal information is governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using our Services, you consent to such processing.

We do not sell or rent Participant information to third parties.

14. Third-Party Links and Partnerships

15. Disclaimer of Warranties

Our Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. While we strive for excellence, we do not guarantee that:

Programs will meet every Participant’s expectations
Events will be error-free or uninterrupted
Our website will be free of viruses or technical issues

Participation is at your own risk.

16. Limitation of Liability

To the fullest extent permitted by law, Agallas Cares and its officers, directors, employees, volunteers, and partners shall not be liable for:

Indirect, incidental, or consequential damages
Loss of data, opportunities, or reputation
Personal injury or property damage occurring at events, unless caused by our gross negligence

Our total liability, if any, is limited to the amount paid by you for the specific program giving rise to the claim (if applicable), or a nominal amount where no fee was charged.

17. Release and Waiver for Events

By attending our events, you acknowledge that certain activities may involve inherent risks. You voluntarily assume those risks and release Agallas Cares from claims arising from ordinary negligence, to the extent permitted by law.

For high-risk activities (e.g., physical challenges, off-site excursions), separate waivers may be required.

18. Indemnification

You agree to indemnify and hold harmless Agallas Cares, its staff, volunteers, and affiliates from any claims, liabilities, or expenses arising from:

Your violation of these Terms
Your misconduct or negligence
False information provided by you
Your infringement of third-party rights
